1. Overview & Who We Are

The Scuber.pro Leads Marketplace (“Marketplace”) is a platform where landscaping professionals (“Pros,” “Contractors,” “you”) can browse, preview, and purchase homeowner leads generated through the Scuber homeowner webapp.

Scuber, LLC (“Scuber,” “we,” “our”) is a Dallas-based company connecting homeowners interested in front-yard landscaping with qualified professionals.

Important Limitations:
  • We are a Lead Marketplace Only: We sell contact information and project details (“Leads”). We do not provide landscaping services, architectural review, or project oversight.
  • No Commissions: Scuber generates revenue solely through the sale of Leads. We do not take a percentage, commission, or “cut” of the service costs or project fees you charge the homeowner.
  • No Professional Advice: Scuber is not a landscaping firm, licensed architect, or advisor. We are not responsible for the feasibility of projects or the accuracy of homeowner-submitted data.

2. Scope of This Policy

This Policy applies to the Scuber.pro Leads Marketplace (hosted on WooCommerce + WordPress).

It covers:

  • Contractor account creation and management;
  • Browsing and previewing Lead products;
  • Purchasing Leads and payment processing; and
  • Marketplace analytics and cookies.

It does not cover the homeowner webapp, Scuber’s corporate website, or any communications or contracts that occur between you and the homeowner after you purchase a lead.

3. What Personal Data We Collect

A. Information You Provide (Pro Account Data)

  • Identity: Name, Business Name.
  • Contact: Email address, Phone number.
  • Operations: Business address, Service categories (e.g., planting, hardscaping), Service area/Location.
  • Security: Password and login identifiers.

B. Marketplace Activity (WooCommerce Data)

  • Browsing: Products viewed (lead previews), Cart contents.
  • Technical: IP address, browser type, device information.
  • Transactions: Billing information, Order history (leads purchased), and dates.

C. Information Included in Leads You Purchase

Note: Before purchase, this data is obscured.

After purchase, you receive:

  • Homeowner’s Name and Contact Info (Email/Phone).
  • Property Address.
  • Homeowner-submitted photos.
  • AI-Generated Inspirational Images: Images selected by the homeowner via our AI tools.
  • Homeowner notes/comments.

D. Payment Information

Payments are processed via third-party gateways (e.g., Stripe, PayPal).

We do not store full credit card numbers on our servers.

4. Why We Collect This Data

  • Account Operations: To create your account and verify your service area eligibility.
  • Transaction Fulfillment: To process payments and unlock the full Homeowner details (the “Product”) upon successful purchase.
  • Communications: To send receipts, account alerts, and (with your consent) notifications about new leads in your area via Email or SMS.
  • Fraud Prevention: To detect unusual buying patterns or unauthorized access.

5. Legal Bases (US Compliance)

  • Contractual Necessity: We process your data to fulfill the sale of the Lead.
  • Legitimate Business Interests: To improve the Marketplace, prevent fraud, and maintain tax records.
  • Consent: For marketing communications and non-essential cookies.

6. Sharing Your Data

  • Service Providers: We share data with WooCommerce (platform), Hosting providers, Payment Processors, and Email/SMS delivery services.
  • Legal Compliance: We may disclose data if required by subpoena or law.
  • Homeowners: We do not share your data with Homeowners. You are responsible for contacting the Homeowner after purchasing the Lead.

7. Cookies & Tracking

We use cookies for:

  • Store Functionality: Keeping items in your cart and keeping you logged in (WooCommerce).
  • Analytics: Understanding which geographic areas have the most demand.
  • Do Not Track Signals: Our systems currently do not respond to “Do Not Track” signals from browsers, as we rely on cookies for the fundamental operation of the shopping cart.

8. Data Retention

  • Account Data: Retained while your account is active.
  • Purchase History: Retained for 7 years (for tax and accounting purposes).
  • Inactive Accounts: We may delete accounts after 24 months of inactivity.

You may request to access, correct, or delete your personal account data by contacting privacy@scuber.pro.

Note that we must retain transaction records for financial compliance even if your account is deleted.

However, no internet transmission is 100% secure.

11. Disclaimers: AI Images, Lead Accuracy & Service Revenue

By using this Marketplace, you acknowledge and agree to the following:

  • Homeowner Data “As-Is”: Scuber acts as a transmitter of information. We do not verify homeowner-submitted photos, notes, or contact details. We are not responsible if a homeowner provided incorrect data.
  • AI Images are Inspirational Only: The AI-generated images included in the Lead are for inspirational purposes only. Scuber does not guarantee that the AI design is architecturally sound, legally permissible (zoning/HOA), or physically possible within the homeowner’s budget.
  • No Service Liability: Scuber is not a party to the contract between you and the homeowner. We are not responsible for disputes, non-payment by homeowners, or the quality of your work.
  • No Revenue Sharing: We do not take a commission on your jobs. Our relationship ends once the Lead is purchased.

12. Pro Responsibilities Regarding Homeowner Data

Once you purchase a Lead, you receive the Homeowner’s Personal Information.

  • Transfer of Control: Upon purchase, you become an independent “Data Controller” of that Homeowner’s data.
  • Your Obligations: You agree to use the data solely to contact the homeowner regarding their landscaping request. You must not sell, resell, or publicly post the homeowner’s data.
  • Security: You are responsible for securing the homeowner data you download or store on your own devices/CRM.
